So you get what’s due to you after road accidents.

Legal protection

optional

Accidents involving your vehicle can often lead to large claims: repair costs, claims for pain and suffering, loss of earnings and disputes with the police and the authorities. The parties involved in the accident often disagree about who should pay. That’s where Legal protection insurance for road-users and drivers comes in. These insurances are important extensions to third-party motor insurance. The latter only covers the defence of unjustified claims for damages by the other party, but not the cost of pursuing your own claims.

Benefits

What’s insured?

Legal protection insurance covers the cost of bringing a claim for damages (including pain and suffering) or disputes about repairs or vehicle purchases. This includes the fees of your lawyer, experts and assessors, court costs (including witness expenses), the cost of administrative proceedings, enforcement, mediation and the opposing party’s costs (where the insured is obliged to pay them).

Legal protection insurance helps with the following types of dispute in particular:

Fixed penalty notices for speeding or parking offences and criminal prosecution for injury resulting from negligence

Infringements of loading and labelling requirements (German Road Traffic Regulations (StVO), German Ordinance on Road Transport of Hazardous Materials (GGVS))

Disputes following repairs or the purchase of a vehicle

Disputes concerning leased and rental vehicles

Disqualification or driving bans

Disputes about the amount of vehicle tax

Optional: dispute with your workers’ compensation insurer about a reduction in earning capacity after a road accident

Differences

Road-user’s legal protection insurance and Driver’s legal protection insurance

Which legal protection do you have?

Driver’s legal protection (Fahrer-Rechtsschutz)

With this module, your drivers have insurance protection in the exercise of their occupation on behalf of your company when driving a motor vehicle on the public highway or as a

  • passenger,
  • pedestrian,
  • cyclist or
  • rider of an e-bike, pedelec (motor-assisted bicycle) or driver of a small electric vehicle.

The vehicles used are not covered.

You are insured when you safeguard your legal interests as

  • owner,
  • keeper,
  • purchaser,
  • leaser/renter,
  • driver

of the number of motor vehicles specified in the policy schedule. You are also insured as a public road-user as a driver or passenger in third party vehicles or as a

The vehicles used are not covered.

Driver’s legal protection (Fahrer-Rechtsschutz)

Road-user’s legal protection (Verkehrs-Rechtsschutz)

All persons (additionally insured persons) are covered in their capacity as authorised driver of or authorised passenger in the insured motor vehicles.

In which areas of the law are you insured?

2. Legal protection for tax
3. Social legal protection
4. Administrative legal protection

For traffic matters only, to safeguard your legal interests in legal traffic cases before administrative authorities and administrative courts.

5. Disciplinary and professional legal protection
6. Criminal legal protection

You are covered for your defence if you are charged with a traffic offence. You are not covered if you are charged with a crime. It does not matter whether the charge is justified or how the prosecution turns out.
